Age of consent in Australia

I'm wondering what the age of consent in Australia is, not that I really need to know, but I'm curious what people are always going on about when they say that a girl is "underage", "jailbait", etc... I looked it up on the Australian government lawlink website and even it doesn't clearly state the ages at which it is and isn't legal to have sex. Is it legal for a 22yo guy to have sex with a girl older than 16, or does she have to be older than 18? Once a guy is over 21 does it somehow become illegal to have sex with a girl over 16 but younger than 18, or is that just in the US? As I said, I don't really care because its not like I'm going to have sex with anyone soon.. because I'm waiting to get married..

  • Here's the rundown:

    It is legal for two people under the age of 18 to have sex. But the legal age to engage in sexual activity is 16. So if a 14 and 16 y.o. get together they can get in trouble. But if two 16 y.o.'s do it's okay. However if a 16 and 18 y.o. have sex the 18 y.o. can be done for statutory rape. Anyone over the age of 18 who has sex with anyone under the age of 18 gets done as a child sex offender.

    • That's the kind of answer I am wondering about, because it seems to vary from state to state. Either way, the legal system is messed up. They should make all australian states and territories have uniform laws.. Hypothetically, what happens if they're visiting another state/territory...? On top of that, how is it any different for someone over the age of 18 having sex with someone over 16 than someone under the age of 18? How is attraction meant to magically change for that 2 year gap?!?

    • This is the overrall law. It does vary from state to state but I'm not sure by how much. I'm not sure what happens if they are visiting. Well the person over 18 is considered an adult whereas the 16 y.o. is still a minor.

  • Independent of the age of consent, it is important to remember that most things are legally discouraged and at lawfully least frowned upon, in region of Australia, wether they define them as illegal or not. It is, after all, born out of a large prison encampment.
