It depends. The laws in ever country is different. If you are in the U. S. and the person in the photo is over 18 then YOU are not the one who can go to jail. If the person in the photo is under 18 then you an be charged with possession of child porn though if that person is older than you and is the one who is in the photo you probably won't be charged.
