Did I consent if I told him I might have sex if he got me drunk?

I was a virgin and I got drunk and fell asleep and I woke up with him inside me and I said I don’t remember saying yes and he said I did because I told him that if I got drunk I might be able to have sex because I was really scared.

  • It's difficult to say it depends on a number of things did you black out before you fell asleep and how does drink affect you.

    The way my ex was could lead to someone getting into trouble without them realising. My ex would be capable of holding a conversation and be completely functional when drunk but would not remember anything.
    On top of this she would get more horny to the point where once she was wanting me to have sex with her in the middle of town. Once we got home and her head hit the pillow she was asleep.

    So what I would suggest is asking your friends what happens to you when your drunk so you know in the future.

  • no you did not consent if you was asleep you didn't consent nothing and even if you did consent before you went to sleep you was asleep so that was a deal breaker he's just trying to get you not to press charges there's no statute of limitations on rape but you have to be able to prove it did you go to the hospital and have a rape test done there if you did then his goose is cooked if you want to press charges if you didn't it'd be awful hard to prove it unless you can get him to admit to it on tape while you're recording him with your cell phone

  • That's... Not really consent. I mean I wouldn't take it as consent since I would think that it was a joke or something. And since you weren't conscious before the actual act to confirm your consent... Well if it was only the two of you it's hard to prove rape.

  • If you weren't awake when things started, that's not consensual

  • Unless you have a witness other than you two, it doesn't matter about consent as you will likely not be able to convict him on anything.

    These sorts are noxiously difficult to prove guilt. But if you have CCTV or witness to prove he got you drunk and dragged you to rape you, then you've a decent case.
