In these 18 states, adultery (married but having sex with someone you aren't married to) is illegal:

Alabama, Arizona, Florida, Georgia, Idaho, Illinois, Kansas, Massachusetts, Michigan, Minnesota, Mississippi, New York, North Dakota, Oklahoma, South Carolina, Utah, Virginia, Wisconsin

In these 6 states, fornication (having sex while not married) is illegal:

Idaho, Illinois, Massachusetts, Mississippi, South Carolina and Utah

Don't tell me that because they may not be enforced that it means it is legal. No. It is illegal because it is against the law, the only criteria that makes something illegal. Whether enforced or not, it is illegal.

Please share if you agree with adultery and fornication being illegal! Adultery is immoral because it is unfaithful to spouse.

Every state in which fornication is illegal, so is adultery but there are 12 states in which adultery is illegal in that fornication is not illegal in.

  • If you are a highly religious christian, or want to follow the rules of the bible regarding this topic, it is totally fine and no one should have the right to interfere with it.

    BUT in a secular country, meaning church and state are separate, the Bible and what is considered a sin shouldn't dictate the laws of the state.

    If you are not a christian, you should be doing whatever you want, if you want to have children without being married thats up to you.

    And i don't see any reason why these laws should remain in place.

    • So secular law means church and state are separate? I thought secular meant contrary to Godly. Oh well. Also, if a law is unjust, Abraham Lincoln said not only should we disobey it but we'd be immoral to obey it. Those were not the exact quotes but it was the jist of it.

  • I agree in many instance. While I don't agree fornication should be as there really isn't a harmed party as consensual sex (unless its rape) however adultery there IS and are MANY who are harmed through such acts. First being the partner who was cheated on. He/she took a vow and made a promise "til death do us part", which is a deep emotional connection and that in itself is heartbreaking and a clear violation of that vow. It can also be construed as breaching a contract especially when finances and homes are combined. It also harms any children within that marriage as it causes trauma once discovered and the heated arguments and possible divorce will harm them for the rest of their lives. Fighting over custody and assets with attorneys who take advantage of the situation is another.

    It can be easy to prove adulterous activities have occurred and if the affair partner had foreknowledge that the one committing adultery WAS married, he/she could be charged as a willing accomplice to such an act

    If we started to actually enforce these laws and prosecute them to the fullest extent, perhaps this will make many potential cheaters and liars think twice before entering an affair and think of consequences far worse of just divorce

  • I am aware that there are a whole lot of obsolete laws in different US states but was not aware of these particular ones.

    The US, its laws and citizens are so controversial when it comes to laws that can be bent, disregarded and misused.

    In this case, some states want to abolish a few insignificant laws because they are outdate but the constitution, which is way outdate should not be touched just because it would infringe on too many citizen's rights. Go figure!

  • It is not enforced often. But it is wrong and I feel like most people feel like cheating is wronged and that giving the party who was cheated on justice will be great as well as prevent cheating from being such a major problem

    It can range from 10 dollar fines all the way up to many many years in prison. I agree with the law and think it should be enforced more often!!!

    • Yes. Meaning technically you could be arrested for it since it is in the law book. It is within their right to charge you with it if they find evidence of it.
