Yeah, I’ve seen photos that are obviously posed, (usually in a McDonalds or Starbucks, if not a nightclub) but the videos… they are always some creep poking his phone under the back of some poor unsuspecting girl’s skirt! Unfortunately, from speaking privately to men about this and viewing publicly available videos on this “up skirting”, revealed that, in fact, the overwhelming amount of women and teenage girls being “upskirted” have absolutely NO IDEA that they are the victim of what is now a sex-crime in most, if not ALL US states! I can say anecdotally (as I did not search ALL 50 states) that at a minimum, “most states” now have some form of “anti up-skirt” law on the books, due to the widely publicized 2016 Massachusetts dismissal of a conviction of a man for up-skirting women on public transportation (including an under-cover officer who was there to catch him) because there was actually no specific law against up-skirting, the police police arrested the suspect for photographing women in a “state of undress” however all the women he up-skirted were dressed, and the appeal’s court noted that it would make no difference whatsoever if the women were not wearing underwear! If they are not at least partially undressed, at the time of the offense, then the law he was charged under does not apply to him, because he was taking “up-skirt” photos in public where people are usually fully dressed.
After that appeals court decision, within just 24 hrs, a new law was drafted, passed by both legislative bodies, and was signed into law by the MA governor! It outlawed taking pictures of women either up their skirt/dress, or down the front of their tops. In fact, I was unable to find any state that doesn’t have some version of the MA anti-upskirting law, banning the photography or videography of women either up their skirts/dresses, or down the front of their tops, without express written permission!
The men who enjoy looking at these videos, have no idea just how much of a violation of a woman’s right to privacy and bodily autonomy this truly is. Asking one’s girlfriend to pose for a few photos is one thing, but walking behind a woman (or in the case of one video) a girl who is very clearly in high school, and secretly placing your phone under her skirt while video recording is despicable! I’m glad that legislators are wasting no time in codifying this as what it is… a sex crime!
