  • The argument is that since a man can “get it up” then he’s “consenting”. It would be near impossible to engage in non consensual sex otherwise.

    The only time it would be if a man is passed out asleep/intoxicated but unknowingly aroused. A woman can get in top of him and he’s not awake to know what’s going on.

    There was a rape scene at the end of the movie “40 days and 40 nights”. Josh Hornet “lost” his pool bet to his rapist ex girlfriend when he was tied to his bed frame, asleep and having erections because he was forcing himself to be abstinent and holding out for his new love interest.

    No one in Hollywood called that “rape” of course. Thats what infuriated me the most.

    Now that scenario is very rare. Not impossible but it requires everything to be perfect. Rather 99% of the time the guy has “beer goggles”, lower inhibitions (and lower standards) and is enjoying it in the moment. He regrets later. But that’s not “rape” and you don’t see men ever claiming otherwise. To do so would be considered beyond the pathetic.

    So why can’t women take personal responsibility for their own decisions? Most do but a growing minority of them call regret “rape” and it’s very scary. It’s not rape if you are consensually enjoying it the moment (yes while being drunk) and wake up the next day to regret it. But feminists are tying to the envelope on this and it’s complete bullshit.

  • Yes, assuming he wants to charge her. If someone isn't "of sound mind" or whatever it is, and someone else takes advantage of that to get off, then yes that is bad no matter who is in which role.

    Honestly even if they *would have* consented if sober, the fact that the other person doesn't care and just, yeah, wait till they are sober—especially when they *don't* know that they would consent, like a hookup where you don't know the person well—that's rapist behavior. And yeah some people find that hot, but that doesn't make it okay. Just wait, and in the future ask (or do it) before they're drunk. If they actually liked you you most likely will have that second, consensual, opportunity.

  • You give no details. Are these people strangers? Were they having sex at some point before the drunk sex? Was permission given earlier? If it was, then there's no rape.

  • I would say the same thing as in your other question with a drunk woman. If someone is too stupid not to realize what might happen when drunk then they should stay home and drink.

    If, however, a woman has sex with an intoxicated man no crime has been committed.

  • Everything is about context when it comes to sex while drunk. Plenty of people go out drinking with the specific intention of finding someone to sleep with, just using alcohol as a way to feel more comfortable doing what they were already planning to do. Then there are cases like a married couple getting shitfaced and then deciding to have a go.

    What matters is, would they have agreed to do it if they weren't drunk? If the answer is no, then it's rape regardless of gender.
