In this case below, would it be considered rape?

this is from a book but it's quite interesting so i am here. can't mention the book coz no spoilers.

Megan is a school s1ut. Lots of people sh9me here. She's done wrong to her former friend Alanis, whose boyfriend Declan and his friend Remy got Megan intoxicated and took her n#de pictures. They also had three way with her. Now the author keeps hinting on how Declan is quite remorseful and has tried his best to get rid of those photos, try to be friends with Megan because he sympathizes with her and has broken up with Alanis. What has me spellbound, he says he was intoxicated himself, and the photographer was mostly Remy. Is he being framed? Can this be passed up as drunk h00kup?

The ending is ruinous. Getting back with Declan would have been better.

Superb Opinion

  • the way it's worded is quite vague. "they got her intoxicated"... like did they drink together and ended up having drunk sex? or did they force alcohol into her as to reduce her resistence as to what they were planning to do to her sexually? i would say the taking the picture part is incriminating if they were leaked or published for sure.

all those fringe rape stories always start with "she drank and she passed out". like what the fuck. i've beend drunk, i partied before... but like i was never so drunk that i wouldn't have tried to stop someone from shoving a dildo in my ass against my will for example. and why is it that when drunk sex happens, it's always assumed that A: the woman did not want it at the time and B: the man forced her to abuse alcohol with the malicious intend to force sexual "consent"?

    • It was a party

    • this information changes nothing xD. well here's a fundamental question: is it morally wrong to drink, to reduce your own inhibitions in order to maybe build up the courage to get sexual with someone? is it morally wrong to try to get a person to drink with you so maybe they are less inhibited, so maybe they have sex with you? like is it morally wrong to have drunk sex? and is it morally right to drink so much that you litterally pass out?

  • Well 1st it's Statutory rape because school so gonna guess underage tho I don't know the country or law it's set under. 2nd too drunk to consent so rape. 3rd Nudity of a underage girl. 4th premeditated.
    All reasons for arrest.

    • She was 18

    • Ah so 1st and 3rd less so. 3rd still unsolicited pictures of a nude woman though.

    • That's a big one

  • If she was too drunk to consent and they both had sex with her, then it’s rape for both of them

  • If she was intoxicated, then she couldn't consent, so yeah, that's rape. Being a slut doesn't change that; hell, being a whore wouldn't change that. You still can say no.

  • Better answered by a lawyer.

    • No thoughts

  • the picture taking was too far and it does sound like there was consent considering she's a slut and this wasn't her first gangbang.

    • S1ut shamer found.

  • When any sex act takes place without both partner's consent, it's rape. A "drunk hookup" is legally rape, and the guy would normally be prosecuted.

    • Really? Wow, I didn't know that.

    • That's such a bullshit lie because you can still sign contracts when you're drunk. I have been severely drunk and nothing about it would make me do something to ruin my life.

  • I definitely consider it to be rape

  • Of course it's rape.

  • I'm gonna yes, because she probably never gave them permission.

  • No, they all consented from what I can see.

    • I thought I was over analysing this—

    • I try to keep things simple if possible, there are too many branches of possibility if you don't brutally apply Occam's Razor.

  • Lol yeah. Sounds like it if they had to get her drunk to do anything. And taking pictures without her consent is definitely wrong. I don't know why it had to start out with her being a slut.. doesn’t have anything else to do with how she was taken advantage of..

  • Sex without consent is rape. No reasons is correct to explain away the incident.

  • That looks like rape, especially if she was intoxicated without her knowledge

  • It could be argued that her ability to object or make an informed decision was compromised.
