  • If she is drunk out of her mind it is rape.

  • This is a very complicated subject. And I think it would depend on the details of the situation.

    But I don't plan on marrying a woman who drinks, so thankfully I will avoid this problem completely.

  • Legally in many places, rape. Ethically, it might be either. If the person is tipsy, then it is hard to argue that all agency is lost. If the person is passed out that is another matter.

  • NO sober person should have sex with a drunk person; that should be rape. Two drunks having sex is a little more difficult to define as rape.

    • Legally it is rape if one person is drunk and one is sober. As the drunk one can't legally consent do to being impaired. Now if both parties are drunk its really a grey area. If they both are drunk and decide to have sex but one person doesn't remember the night before that person man or woman can tell authorities she was raped. But most likely it will be up to the county or district attorney to decide whether or not to prosecute. This is were the CA/DA could charge both people with rape. Or it could be not prosecuted.
