Is tickling with no sexual purpose considered as rape?

If a guy is normally tickling a girl stomach area to thighs over the clothes and holding her hands but without doing anything sexual , does it mean it's some sort of rape since it's forced tickling while she wants him to stop?

  • I don't think thats sexual abuse no, non-consent sure. I think we've all had this done / done this as kids as some point though, it was very common.

    • You're right but assuming it happens for a teenager and not kid

    • Kinda similar, its intended playful though. Personally I don't do it unless its my girlfriend.

    • I agree with that

  • No tickling isn't rape and what kid hasn't tickled their friend to the point of them pissing their pants at least once in their life?

    • I guess you're right

    • Yup.

  • I don't believe it's classified as sexual abuse.

    • Then it's sexual assault? Based on some other comments

    • Touching someone without their consent can be considered assault. Depending on the context, possibly a form of sexual assault. Generally though, I can't see the police/prosecutors would care to follow up tickling or grabbing someone by the arm unless it is recurring offence by someone doing in to random people. As an example a doctor does it to its patients. A stranger runs around the streets and tickles bystanders. It takes a lot though, and proof, for this to be investigated and taken further.

    • That's a solid explanation

  • Definitely not.

    • I got it

  • So just to clarify, you are asking if tickling is rape?

    • Pretty much

    • Ah okay. No, tickling is not rape

    • Even if forced? Like you know how it makes you laugh and you want it to stop but the person keeps tickling more so it can be similar to forcing a tickling on you while you don't want it to happen, thoughts?

  • If a lawyer would have a go at it, I assume he would file it as „false imprisonment“. 🤔

  • No rape is a form of forceful sex

    • None consensual sex

    • Fair

    • Pretty sure it comes under assault or battery

  • Not anything sexual about it so not probably "rape" legally

    • Fair enough although some people tends to say tickling is sexual thing which makes no sense to me

    • Yes I guess they are the ones who get sexually aroused/turned on by tickling.. so for them there is a sexual aspect to it..

    • Oh that makes more sense

  • You need to see a therapist if you even remotely think thst way.

    • Me? It's just a question, has nothing to do with me.

  • It is not rape by the legal definition but it could be a lesser crime like battery if it was against her will

    • Thanks for the info

    • I would dump the guy if he does that to you again

    • It's all good

  • I will kill someone for doing that to me

  • if it's non-consensual, it is a form of assault

    • I get it

  • No penetration -> no rape.

    • Fair point

  • Could be considered harassment, not rape.

    • That's more accurate

  • No, by definition it cannot be rape. It's assault however. And if done with sexual intent, sexual assault.

    • Fair point

  • No. Rape has a mens rea requirement.

    • Got it

    • It can still be assault though.

    • Yup someone explained it that way

  • If she wants him to stop, he should, otherwise it would be non-consensual.

    • That's true

  • Nope

    • Got it

  • If she says stop, then stop

  • Not tape, not at all.
