    All sexual activity has to be consensual on both sides. Meaning although he's your boyfriend, he needed to be conscious and consenting to you he wants sex with you in order for you to actual to do.
    He was asleep/not fully conscious and unable to say "yes" or "no" to any sexual intercourse and activity, so yeah this is the legal definition of rape.

    I'd advise you to ensure you get consent from your partner first, and don't do things like that when people are sleeping or half asleep.

If the person doesn't clearly state "yes" while in a clear state of mind which includes being asleep, suffering from sleep deprivation, brain fog or confusion from a medication or illness, drug use including marijuana and alcohol, consent cannot be legally given or obtain. Even a single beer or glass a wine is enough to prevent obtaining consent. These laws were put into place to protect women but they still apply to men too. It doesn't matter if you personally believe someone could sleep through it or not.
