So drunk sex. How do we determine rape?

I’ve heard bravado of guys saying they troll bars for drunk chicks. I’d consider that rape.

If both are drunk it’s not rape? How drunk does each person need to be for it not to be rape? Just seems like a cesspool of shit.

  • It’s tricky, my wife had something like this happen to her when she was younger, we never pressed charges or even investigated it, And that’s that we let it go.

someone slipped something in her drink, I’m pretty sure, and she doesn’t even remember anything that happened,

a group of guys left her on my porch passed out with her panties in her pocket, Then the car sped off……..

i picked her up carrying her inside. And I found her panties I. Her pocket of her sun dress, I pick her dress up and check her, and she was full of cum, (Creampie).

im almost positive that more than one guy had her. Probably the whole bar. I cleaned her up, and put her in bed,

the next day she didn’t remember any of it, and we got a rape test/kit done,

she was indeed raped, and there was more than one guys DNA in her. Meaning they were takeing turns with her.

they asked us what we wanna do and we let it go, But unfortunately she got pregnant from that day. we decided to keep it.

that’s what happens when you let a pretty young, blonde girl go out by her self.

    • Should that be what happens when a pretty blond girl goes out? And I would have nailed each of those dna profiles to the wall by their testicles. Via the law, or my own nail gun.

    • I go to the same bar, and felt comfortable there, she was there with some co workers after work, and I’m ok with that. But they stayed out late, and drank more than they should have. A bunch of girls from her work I told her be safe and have fun, and didn’t think anything of it because I knew the place she was at. And I knew the staff. It shouldn’t have happened, but it did, We have a daughter because of it. and Wel leave it at that. Never again. She wasn’t hurt, and they at least brought her home when they were finished with her. It could have Ben a lot worse

    • Lol, at least they brought her home after they raped and impregnated her with her cuckhold baby. Don’t get me wrong, you score points with that. But you seem blasé with the rape. Like it was all her fault and not the guys who…raped. Do women deserve rape if they get drunk?

  • If you’re both drunk, it’s not Raine if you got some sober dude, going around looking for intoxicated women to have sex with. I would say that’s probably rape. “ Alcohol brings three things Mary banking, urine and desire. Unfortunately it weakens the desire.”

    • I will ask for a rephrasing of this post. :)

    • Stupid voice to text. If you’re both drunk it’s not rape, If you’re a sober dude who goes around looking for intoxicated women to have sex with its rape.

    • Totally agreed. I asked this a few years ago I think and so many guys said they do that shit. Prob still do.

  • If a woman chooses to go out at night half naked with her boobs out and get herself drunk then she is equally as responcible for "rape" as the man is if he is also drunk. I wouldn't even call it rape.

But if someone else poison them and then have sex with them then yes that's rape.

    • And if the guy isn’t that drunk? Or not at all and targets her? How do we measure”

    • Depends. I think if the woman chooses to go out to a club, be half naked and make herself drunk. Even if the man isn't drunk its still not rape.

    • That seems like an unfit consequence for a girl who goes out drinking.

  • i agree with you 100 percent

and any guy who trolls knowingly looking to swoop in on some semi conscious, blasted out of her mind girl, is a predator, woman have to be more proactive these days, true it should never happen but unfort it does everyday around the world.

    • I hope Promising Young Woman is a real thing.

  • If you can't handle your drink you shouldn't go out... it's only rape if you get drugged..

  • If one does Not want IT is rape.

    Equal if man or Woman

    Both can be victimstI guess

    • Very true. But of course there are variables and facets. Like both are drunk but the guy sobers up faster…or she regrets it in the morning….

    • It doesn't matter. Alcohol is not an excuse. We are all adults. You can't say, I'm sorry I was drunk.

    • Consent vanishes when drunk

  • Easy. If you're drunk and the dude, it's never rape.

If you're the chick, it's rape under any of these conditions:

    He wasn't any good.

You regretted it the next day

    Your boyfriend/husband found out.

At any time in the next 20 years he pisses you off.

Exceptions will be granted to if you ever attempt to go into politics, in which case the 20 year statute of limitations is extended to 99 years and moves the burden of proof onto you.

    • All women are victims and all men are perpetrators.

  • drunk sex is rape unless you were talking to her before she got drunk and was into you sober. always bring a friend to make sure you don't get screwed/raped

    • Seems crazy dangerous. Like a minefield…

    • better off just skipping the sex. you might still get a rape charge because she can't remember if you raped her or not

    • It’s tough situations. Why even the hint of drugs or alcohol tosses confessions in court.

  • If my girlfriend gets drunk in order to allow me to do whatever I like with her (say she would get irritated by those sensations when awake) she made a conscious choice, but then while drunk / sleeping she's not consenting to anything I'm doing. Is that rape?

    • So she made a decision pre drink to get drunk to allow you to do…whatever?

    • Yes. Supposedly for the reason because if she were conscious she would not let me do it. I suppose it would depend on the reason (or would it)? Like if the reason is pain then sure, do it while she's unconscious, alcohol acting as a bit of an anaesthetic. But if she thinks it's "too dirty" and she wouldn't let you do it even if anaesthetized (but awake) then is it okay if she says you can do it while she sleeps? Yes she allowed you, but YOU KNOW she doesn't WANT you to do it. And what if she considers it immoral (or worse even, unacceptable by her religion, let's say anal)? She lets you because "if she doesn't know about it it's not a sin" and of course just because she allowed you doesn't mean you did it and as long as you agree never to tell her if you ended up doing it she can keep a pure innocent heart. Maybe. But would you go ahead and do it? Can get tricky. Where do you draw the line?

    • Eeesh, thats grey zone.

  • So drunk sex. How do we determine rape?

Under the law in most states a druck person is not capable of giving consent, but unfortunately, proving rape can be the tricky part. My best advice is not to have sex when one or both parties are drunk.

  • There's a big difference between tipsy and blackout drunk. Plenty of guys who would be drunk and end up going home with someone they regret in the morning.
Obviously if someone is so drunk they can't conciously consent it is rape

  • Rape is rape regardless of the amount of alcohol someone has.

  • If both are intoxicated, it's not rape, unless, during the intoxication, one forced the other. If there was mutual enjoyment, it wouldn't be rape.

Now, if one was sober , and the other intoxicated, with no capacity to consent, that's plain rape.

    • How intoxicated do each have to be? Girls unconscious and your drunk but functional?

  • Here is a very simple rule: if you are legally allowed to sign a contract still? It is not rape.

You can be fucking wasted and sign a contract.

    • How do they measure that?

    • Ask the judge, your mileage will vary.

  • If you are an adult and you go out drinking you are responsible for your own actions. If you are passed out thats a bit different as you cannot control your actions anymore.

If you can be responsible for driving while drunk then you are responsible while having sex drunk.

    • Good point with DUI. But the guy raping you also has accountability. And girls just getting drunk shouldn’t have a consequence of rape, should it?

    • Women are never responsible for anything except possibly driving drunk. Certainly not for sex, drunk or sober. That seems to be what the law is.

  • Rape is when a female carries out sexual contact without consent.

    Simples...

  • She has to give verbal consent. Even if she doesn't recall, if it can be proven that she consented it's not rape.

  • Either women accountable for their actions (equality) or they are not. If she is voluntarily intoxicated she can consent to sex, full stop.

  • Like this -

If the woman is drunk it is always rape and the man's fault if he instigated it or not.

If the man is drunk and the woman is not and she instigates it is the man's fault.

If both are drunk it is the man's fault no matter who instigated it.

If the woman says she was raped it is a crime

If the man says he was raped it is a joke.

    To make it easy -

It is ALWAYS the man's fault no matter what.

IT is NEVER the woman's fault no matter what.

    • I get you. And we’re starting to look more at women’s accountability in say DV or teachers raping their students. But it’s still a small % of actual rapes right? Horny men with hard dicks are the majority of rapists? Not all men, but most rapist.

    • *Reported rapes* Not actual rapes. Men don't report rapes. Women do, and a lot even if they didn't happen.

    • Haha I should have scrolled down before posting... you beat me to it! :)

  • It's tricky. The laws are subjective on the matter. Its generally only rape if a drunk woman has sex regardless on whether the man is drunk or not and only rape if the woman regrets the sex the next morning, is upset the guy didn't call or cheated on her boyfriend or what's attention. If a drunk man had sex with a sober woman it should be considered rape but any law regarding it will not be enforced, in fact the police and court will laugh you out of it. I'm guessing two drunk lesbians who have sex cancel each other out in regards to rape where with a drunk man and drunk woman the woman can claim rape.

Sex with a drunk woman can be pretty awesome but what I would say is be sure about the woman, make sure it's your girlfriend and you trust her rather than some drunk one night stand who may decide she was in no way responsible for her actions just because she was drunk or took drugs. I've had drunk sex with my fiancee often when she comes back from a night out with her friends, I've had her fall unconscious after orgasming and I'm left to finish in her.

Sleep sex is also pretty good. You wake up in the middle of the night and slip into her while she sleeps. But it all depends on the woman and if she's cool with it.

So drunk sex. How do we determine rape?So drunk sex. How do we determine rape?
    • I mean…all true, even though I a small percentage of actual raped women. But boys being “raped” by say teachers seems to be something we let slide unfort. So I get what you say.

    • Yeah teacher has sex with an underage boy and she gets a slap on the wrist, a book deal and interviewed by Dr Phil.

    • Again you’re not wrong. And from my reading, this doesn’t seem to “feel” like rape to the boys as it does to the girls. Although even if the girls don’t ‘feel” raped by their teacher I would nail him to the wall. Weird double standard.

  • Any alcohol involved with an party has the grounds to form a rape case

    • Yeah…minefield.

  • If she's drunk, and you're not, it's rape.
If you're drunk, and she's not, its rape.

    • Very true. Just seems Iike it’s not that black and white in real life. What level of sobriety for the guy AND girl?

    • It's very clear cut until you're both intoxicated. It isn't a level of sobriety, but a level of intoxication.
