Yes. Supposedly for the reason because if she were conscious she would not let me do it. I suppose it would depend on the reason (or would it)? Like if the reason is pain then sure, do it while she's unconscious, alcohol acting as a bit of an anaesthetic. But if she thinks it's "too dirty" and she wouldn't let you do it even if anaesthetized (but awake) then is it okay if she says you can do it while she sleeps? Yes she allowed you, but YOU KNOW she doesn't WANT you to do it. And what if she considers it immoral (or worse even, unacceptable by her religion, let's say anal)? She lets you because "if she doesn't know about it it's not a sin" and of course just because she allowed you doesn't mean you did it and as long as you agree never to tell her if you ended up doing it she can keep a pure innocent heart. Maybe. But would you go ahead and do it? Can get tricky. Where do you draw the line?

Under the law in most states a druck person is not capable of giving consent, but unfortunately, proving rape can be the tricky part. My best advice is not to have sex when one or both parties are drunk.
There's a big difference between tipsy and blackout drunk. Plenty of guys who would be drunk and end up going home with someone they regret in the morning.

If both are intoxicated, it's not rape, unless, during the intoxication, one forced the other. If there was mutual enjoyment, it wouldn't be rape.
Now, if one was sober , and the other intoxicated, with no capacity to consent, that's plain rape.

If you are an adult and you go out drinking you are responsible for your own actions. If you are passed out thats a bit different as you cannot control your actions anymore.
If you can be responsible for driving while drunk then you are responsible while having sex drunk.

Women are never responsible for anything except possibly driving drunk. Certainly not for sex, drunk or sober. That seems to be what the law is.

I get you. And we’re starting to look more at women’s accountability in say DV or teachers raping their students. But it’s still a small % of actual rapes right? Horny men with hard dicks are the majority of rapists? Not all men, but most rapist.

It's tricky. The laws are subjective on the matter. Its generally only rape if a drunk woman has sex regardless on whether the man is drunk or not and only rape if the woman regrets the sex the next morning, is upset the guy didn't call or cheated on her boyfriend or what's attention. If a drunk man had sex with a sober woman it should be considered rape but any law regarding it will not be enforced, in fact the police and court will laugh you out of it. I'm guessing two drunk lesbians who have sex cancel each other out in regards to rape where with a drunk man and drunk woman the woman can claim rape.
Sex with a drunk woman can be pretty awesome but what I would say is be sure about the woman, make sure it's your girlfriend and you trust her rather than some drunk one night stand who may decide she was in no way responsible for her actions just because she was drunk or took drugs. I've had drunk sex with my fiancee often when she comes back from a night out with her friends, I've had her fall unconscious after orgasming and I'm left to finish in her.
Sleep sex is also pretty good. You wake up in the middle of the night and slip into her while she sleeps. But it all depends on the woman and if she's cool with it.
