I think stealthing is a pretty horrible way to treat someone, but I don't think it's right to call that a full sexual assault. What if the condom breaks, and the woman decides to report the guy as a rapist for revenge, or some such thing? I would vote for the addition of a sexual indiscretion misdemeanor. I feel like there needs to be a way to punish guys who misbehave without potentially destroying their lives.
