Please see the following scenarios, because from the questions i have seen There is a colossal double standard here.

Scenario 1: Both are at the same level of drunkness, They both go back to her house and have sex. THERE IS NO FORCE, No one said no, no one regretted it the next day though their memory of it is cloudy.

Personally i see the first one as no one got raped, because both were impaired.. How ever i guarantee that there are leftists on this site who will say, The man raped the woman regardless of level of drunkness. When if you're a rational logical thinking person, and you believe that the rules of consent apply to both sexes EQUALLY then you will come to the same conclusion i did, that either there was no rape, or both raped each-other.

Scenario 2: One, The woman is sober, Two, the man is heavily drunk. They both go back to her house and have sex. THERE IS NO FORCE, No one said no, no one regretted it the next day though his memory of it is cloudy.

Personally i don't see that anyone got raped here either. But i guarantee the leftists on this site will see it as the man raped the woman, because the man is always at fault to them. When if you're a rational logical thinking person, and you believe that the rules of consent apply to both sexes EQUALLY then you will come to the same conclusion i did, that either there was no rape, or the woman raped the man because legally he could not consent.

Where I live, none of those are legally considered assault. “Too drunk to consent” quite literally means you’re like slurring so badly you can’t say yes or no, or so drunk you don’t know what’s happening. Making uninhibited decisions is not “too drunk to consent” unless the other person secretly slipped alcohol in your drinks.

a lot of schools have policies that essentially say any sex under influence is a violation of school policies. Anti rape activists have pushed the message that any drunk sex is rape. Legally it’s not true very many places. Interested to see you point out some places “impaired judgement” nullified consent. I think some US state did right basically a one drop alcohol rule (Wisconsin maybe)? But that’s absolutely not the norm.

The push is also, in my mind, misguided. Yes people sometimes have sex they regret and sure we can all talk about it more. The issue is it blurs accidental feelings hurt with the fact that maybe 1-2% of men are serial predators who are fucking nearly passed out girls or ones so drunk they’re easily overpowered. They know damn well what they’re doing but when it happens people aren’t sure if it’s just “oh they were both sort of drunk”.

I agree that in cases where both parties are too drunk to consent that it's not rape. In scenario #2 the issue is that it's not rape because she did not penetrate her victim, though it was sexual assault, rape is defined as penetration by US and UK law.

All your scenarios sound the same lol. Basically, i watch #DaysOfOurLives and that little hoe Allie pisses me off. She was hoeing around and got drunk. Someone took advantage of her and got her pregnant. I initially didn't pity her because it took her a YEAR to randomly remember she was taken advantage of because the whole time she thought she willingly had sex. The one guy who was nice enough to take her home safely, she's accusing him of the rape. In reality, someone else came in after he left and raped her. I do pity her but she was being dumb by getting drunk alone in a bar full of guys. She should've been more responsible. But also the guy who took advantage of her deserves to be in jail... we’ll find out who he is once they do some dna tests

Noone got raped in any of those scenarios unless someone is purposely or forcefully getting someone drunk just to achieve sex from the other or slipping drugs into their drink... But if both parties equally chose to drink/consume the alcohol and equally consented, engaged in sexual activity than again that's not rape... And if people can't handle their drinking then they shouldn't drink, simple 🤷🏼‍♀️

let me give you a different situation, one that actually happened to me. I was sober, but sleeping, The girl was drunk, I woke up to her trying to ride me, i told her to stop, I tried to push her off of me, Once i got her to stop she told me that she can make me feel good, and then in the same conversation she said that i must be gay. I hated that situation. I lost a good friend that night cause i couldn't trust her any more. But if we go with the logic of impaired = rape, Even though i was asleep, then woke up and stopped her, i technically raped her, even though she, as far as im concerned sexually assaulted me. I don't think the law should be that black and white. I think it should both take into account who was impaired along with how they feel after. Otherwise you will have situations where one person does not want to press charges, but the state does it anyway..

None of those scenario's are rape. The only time one can argue it was rape is if the person was blacked out drunk and did not consent before hand. If they consented and then blacked out and the other person is also drunk, I don't see that as rape just both parties being stupid. If however one of them was sober and the person blacked out then that is intentionally and knowingly exploiting the situation and I would say that is rape. but of the scenarios given, none of them are rape.

You can rape someone and not intend on doing so. Someone who is impaired cannot consent legally, as their judgement has been impaired.

I feel like the reason you asked this question was because you saw something like this picture that makes the assumption that the man will be charged with rape no matter the context.

Which also begs the question if this logic will continue to be used: what happens if a gay couple have drunk sex? Who is responsible?

you are responsible for your decisions. If you take a decision impairing drug (willingly) then you are responsible for your decisions made in that impaired state, because you chose to impair yourself.
