Should leaking nudes be a prison worthy offence?

  • "The Fappening" was more than just pics shared without permission - it was a couple of people who broke into celebs' cloud accounts (almost all being iCloud, as it had a huge security hole at the time) by using known email addresses and using other public information about them to guess their passwords. (Note: if you use your dog's name as your password, and you go on TV and tell everyone what your dog's name is, you're an idiot.) That's the point where it was unequivocal that this person obtained unauthorized access to those pictures, and why he went to prison.

    But, legally, it's a very different situation if, say, a girl sends a guy a nude and that guy turns around and shares it. He HAD permission to have the photo in the first place. It's also different if, say, someone TOOK a photo of a person in a place that was visible to the public, such as a beach, or on a boat in the ocean. Many celebs have had topless photos released when they were on a boat or beach in "public view" and some paparazzo took their picture and sold it.

    If you get naked within public view, you can't have any expectation of privacy, and likewise, if you send out a nude, you can't (legally) have any expectation of privacy. That's the law, and it's up to everyone to take that into account and adjust their behavior accordingly.

    Everyone should understand that, in a world of Internet-connected cameras, that if you allow pics/videos of yourself to be taken by someone else, or take them yourself and share them, then you no longer have control of who sees those images. What's morally right is not the same as what's legal, but making such sharing illegal (i. e., making the current law more restrictive) would overwhelm law enforcement and would cause unreasonable restrictions on people's 1st Amendment rights - do you want to have to ask permission, or have to keep records of photo releases, just to post a selfie on Instagram? That's exactly where such a law would lead.

  • I believe that hacking into someones shit is bad and criminal. I believe that anyone who does something wrong should pay for their crimes. BUT... I also believe that a lot of shit is "leaked" instead of leaked. When someone leaks their own shit and they go "Oh.. oh no. Woops. Too bad". I find it sketchy that this shit happens and the peopled who got "leaked" don't pursue criminal charges. If that site your talking about has been around fir a while, it's likely for a reason. You go to pirating websites and they're always changing their domain and then they end up getting shut down. If there were a lot of celeb leaks and the celebs pursued criminal charges, there's no reason why that site would still be up.

    • Her comment is not "quite" accurate. 41 states in the USA have "revenge porn" laws making it a crime. Canada is in the process, but it's up to each province. Mexico just passed a law in one of its chambers that is in review in another for final approval. By the end of 2021, most of North America will have such laws in place, but a few states in the USA may hold out.

  • Well I think when I share my pictures with some one I'm hoping she keeps them to her self and I'm the same way if a person sends me pictures that's between both of us and she is trusting in me that they are for my eyes only and I respect and honor that its only right
