Will I get in trouble if my ex has a restraining order against me but we are still having sex? It’s a temporary restraining order.

  • As long as the order is active, yes, you could potentially be arrested for violating it. You’re playing with fire because he could use that restraining order to set you up. I’m guessing that the fact the order exists in the first place means things have not always been amicable between the two of you. If you want to continue with him, you should insist that he have the restraining order lifted. He can absolutely do that.

  • It depends. It could be a crime for you. It could be considered that his action waived the TRO. It could also be a crime for both of you depending upon the wording. Check the laws and the specifics of the TRO. Some are stay away (no contact). Some are peaceful contact. Also check to see if in the jurisdiction the person with the retraining order can waive it. His willingness to have sex with you is prima facie evidence that he did so.

  • That sounds jacked up. He has a restraining order against you, but is still having sex with you? What is the restraining order for? He must not be totally behind it if he is having sex with you under the restraining order. This is an odd set of circumstances.

  • My understanding is that restraining orders are not applicable or enforceable if the sex is really good. But be prepared to demonstrate in court exactly what was done that made the sex so great.
