In most if not all states at the minimum under age sex is a misdemeanor. And on top of that statutes apply usually a 2 year rule if I'm not mistaken. Meaning if there is more than two years apart even if both are under age it could be considered statutory rape.

No state says that, the offender has to be 3+ years older for it to be an offense. So they have not broken the law.

If they're not old enough to give consent then it may be illegal to have sex regardless their age differences between them are.
