No, in Western society, they should be arrested, tried and convicted, and then sentenced to what would be considered "Reasonable" punishment.
Some have been know to fall down, quite frequently, during the arrest process, or even before, should family members become away of some abuse.
Accidents happen, and I certainly AM NOT condoning violence, and abuse, in any way.
During the attack, yes you are. That is self-defense. After the fact, you are not. Since the immediate danger has passed, that is now purely in the hands of police and lawyers.
