A new Texas law that bans abortions after six weeks of pregnancy includes a $10,000 incentive that could fuel an anti-abortion economy in the state. According to the law, private citizens can sue anyone seen to be "aiding and abetting" an abortion — whether or not they have any personal connection to them. Anyone found to have advised, helped pay for, or given a ride to an abortion clinic is fair game, including teachers, parents, clergy, Uber drivers, and friends.

If the plaintiff wins the case, they could be awarded a minimum of $10,000, plus attorneys' fees. The defendant, on the other hand, would not qualify for legal fee relief, no matter the outcome of the case. In this way, the law incentivizes widespread prosecution, with no disincentive for baseless claims. In a statement Wednesday, President Joe Biden said the law "blatantly violates" Roe v. Wade, which gave national protection to abortions in 1973.

11 42The Supreme Court is never going to overturn Roe Verses Wade. Courts virtually never overturn their own decisions. Have you ever asked a Judge or a panel of Judges to overturn her/his/their own decision? That's the major reason why the Appellate Court system is so overwhelmed in this country, even before the pandemic. In just over 245 years, the Supreme Court itself has only overturned less than 2% of their own decisions, and there's no Appellate Court higher than the Supreme Court. I'm morally pro-life and legally pro-choice. Whether people in this country like it or not, Roe Verses Wade is the law of the land.

The Supreme Court is going to strike down this new law in Texas, even with conservative justices on the Court. Conservative justices tend to be law traditionalists, and make decisions based on precedent and caselaw, even if they morally disagree with the decision. Roe Verses Wade is precedent and caselaw. Anything is possible, but I'd be shocked if they upheld this Texas law.

The Justices also suggested that their order likely isn't the last word on whether the law can stand because other challenges to it can still be brought." They blocked an emergency appeal application. Key word "emergency". I highly doubt that this law will be upheld after a full application.
I guess we'll soon find out.

@legalboxers Regardless of Donald Trump's reason (s) for picking the three Justices he did, the Supreme Court relies heavily on precedent and caselaw history. If you read the decision that was handed down against the emergency appeal application (and read between the lines of Chief Robert's statement), it was a procedural denial, and not a merit-based denial.
