  • That depends on a lot of factors, most of which wind up being irrelevant as you never know what other people are thinking. I mean, it's still cheating regardless, I've never seen women get fall down drunk unless they have people they trust looking out for them, typically other women, or guys they're already sleeping with.

If she gets taken advantage of in that situation, either her friends betrayed her, or she wanted to, but perhaps got beer goggles on, and what she woke with wasn't quite what she saw herself going to bed with.

I just don't sleep with women that are drunk as hell since buyer's remorse is drama I don't want to deal with. We actually have a law down here where it can't be rape if both parties are taking drugs or alcohol, as taking them with each other is enough familiarity and letting down the defenses to not have probable cause of a crime there.

  • The one thing about this no one ever really considers is, when a girl is drunk, or even a guy if sex does take place, the alcohol often throws off the person's senses, and they only remember bits and pieces.

When the person sobers up, they often don't remember if they wanted to have sex or not and become scared that they were taken advantage of. Drunk or not, if the girl strips her clothes off and allows the guy to have sex with her, as long as she was Ok with having sex, and didn't ask him to stop, then it's consensual.

If the girl gets on top or takes control, that applies double. What happens a lot of times is the girl regrets her decision and calls rape. Any girl that does that isn't responsible to have sex.

  • i remember before the secretary of my doctor shared to me that his boyfriend raped her he nade her drunk... i've never been drunk so i cannot really tell if while in the state of alcohol you can give consent. if you're a person who is sleepinh on the side of the road due to alcohol intoxication that looks like a person who cannot give consent. it is not cheatinh but it's rape. usually the rape i know is the one i see on tv where the woman is then brutally murdered but there's even marital rape so i think this can often happen just not reported so yeah be careful on the people you hang out witj

  • Cheating... women need to take responsibility for being sexually active when drunk..
Personally if a guy fucks you while drunk its your fault.. never leave yourself in a vulnerable situation or take responsibility for what happens.. Absolutely men should not fuck drunk women who can't talk or walk but if you are still aware it is your fault.

  • Honestly this is scary as what it is because if those are your only two answers that you could come up with then I would think that you would be saying what the scenario was what's the details what got it started why are they with each other did they go out together did they start making out there's so many other things that we have to know before we can answer that
If a girl is by herself and then she's drunk and she starts talking with the guy and she wants to go home with the guy or does the guy just throw her down right there there's just you need to know more of the storyline but it's probably going to be rape but only if other things happen or didn't happen

  • Guess it would depend on whether it was her choice or she was forced.

  • its rather stupid to get yourself in that position, its about trust

  • There are many degrees of drunk. Is the person to drunk to give consent? If so, their sexual companion may be guilty of sexual battery. However, each person is resonsble for the consequences of their drinking and if they have sex with someone else while under the influence, then they have cheated.

  • Cheating or stupidity

  • I would say it´s still cheating if you´re drunk and having sex since you still brought yourself in the situation.
It would be rape if it´s clear that it´s not consensual sex.

  • alcohol is not an excuse for sexual behavior

  • There is definitely a very fine line between drunk sex and rape. I think it all depends on the level of drunk the person is. If they’re drunk enough to not remember the incident or not know what they are doing, then that would be rape. If they were just really messed up, then I think they just made an impulsive decision. Same goes for cheating. Your inhibitions may be lowered, but if you’re not in almost a stupor then you still chose to do it.

  • Couples drink all the time together. Many dates involve drinking. It's not rape because there was alcohol involved, or every woman that's ever bought me a drink would be in prison. NOW... if someone is passed out, that's rape. If you're getting drunk with another person that isn't your significant other to the point you can't function, that's cheating. And pathetic.

  • That depends. If someone’s unconscious and someone takes advantage. Yes.

    If someone consented…. No.

  • depends how drunk we're talking and if the other person is drunk too or not. most likely cheating though, not that many people go around fucking passed out or borderline passed out people especially if they're stone cold sober

  • People are still responsible while drunk. Alcohol just lets out what is ALREADY in there.

  • Cheating

  • I would say since the person is drunk. It would cheating. As for the part about being rape. Thats a hard question 2 answer. Reason some women that get drunk have sex. But cause they was drunk they want 2 say rape. Especially if somebody is a complete stranger. Anyway u look at it its cheating. Dont get drunk that way things want happen beyond ur control.

  • If you can't legally drive then technically you can't consent. The twist is if the person decided to cheat and got drunk to facilitate it or if they started out saying no and then were given alcohol to lower inhibition by the other person.

It could be both at the same time.

  • It's still cheating. They should be aware of where they're getting drunk. But drinking isn't a good habit either way.

  • Drunk or not, it is not rape if the sex is consentual.
Feminist loons have had laws passed that inverted that logic. They say that after one drink a woman cannot give consent.
Out of one side of their mouths Feminists say that a woman who has consumed any alcohol is mentally unfit to consent to sex.
Out of the other side of their mouths, Feminists clain that women are as capable and compent as men.
The two positions are contradictory and good examples of the cognitive dissonance of the Left.

  • Tipsy kind of drunk, cheating.
Full drunk but the other person is also drunk, cheating.
Blackout drunk or drunk to the point you can't even fight back, rape.

  • If a person is drunk legally they can't give consent consent. So yes it is rape.

  • Both.
