Only if it's self-defense, like with anybody else. You can't make different laws for different people.
As long as you are defending yourself from harm you can beat the pulp out of him and I really hope you do. If you wait days after the attack to kill your attacker you can be charged with premeditated murder.

No, assault by any reason is still assault. Now unless he/she is actively doing it towards you or someone else, then it be self defense but if he/she isn't then you be charge with assault
