Do you feel someone having sex with their spouse while they're asleep, is essentially rape?

I was watching an old episode of Dr. Phil where this couple was on there and the husband admitted to having sex with his wife while she was sound asleep. He said "he wanted to see if he could do it without waking her up", he also thought it would be "funny". So, do you believe if a spouse has sex with their spouse while they are fast asleep, that it could essentially be defined as rape (since they are not awake to give consent)? What do you think?

    In Sweden and some states in the US it is rape (The man in Sweden had sex multiple times with her before going to sleep and then had sex with her when she was (half) sleeping. Famouse because the man was Julian Assange and the Swedish authorities try to get him since years)

  • Some people are ok with this kind of thing when they've already had sex and know each other, I could see it happening out of the blue and a woman being ok with it. But if they've previously said it's ok then it's definitely totally fine. Best say something to your partner first.

    If there's previous and recent sexual history there then I'd say that's extenuating circumstances and not going to be called sexual assault unless it continues after a no or safeword.

    If we say that sleeping people can *never* give consent then that also means things like wake-up blowjobs become sexual assault even when we want them.
