Is forced fingering considered rape?

I was sexually assaulted by my coworker one day, but it wasn’t the termed “sexual intercourse” that is culturally defined as rape. He undressed me and used his fingers, which made me bleed, and forced me to perform orally on him. I’m currently in therapy, but am wondering what you would consider “rape?” With all this #metoo stuff (which I personally find very offensive and discreditory) I’m curious. Does somebody violating your body in this way classify as rape to you, or simply the notion that a man stuck his p**** up there? What makes that any different from it being his hand? What makes the effects any less severe?

I’m just asking this question because there’s been so much hyteria over rape the past few years and it just seems like it’s become something of a trend, to where “rape” is just THAT word and accusations fly every day, almost discrediting those victims who have very personal and severe effects from it. And I also did not ask for him to turn it around on me and make me out to be a slut so that I quit, nor for him to come into my new place of employment to tell everyone that I lost my previous job for messing around with coworkers/management. That’s what I’m talking about. And I simply don’t think we need all these shades of rape. I think rape is rape and sexual assault/harassment anything other than penetration. I respect everyone’s opinions, however.

  • In my opinion, it's anything sexual that goes against the will of the woman that constitutes it as rape. It doesn't have to be penile penetration to have your will violated. He also forced you against your will to perform oral on him as well. That is rape.

    It's not the act or how "loudly" a woman tells him to stop. It is the violation of the will and intent of the woman that makes it rape or not. Even if it is considered "sexual assault" where you are, he is still subject to prosecution under the law, which he should be.

    I think we walk a very fine line as a society when we try to slice and dice and make semantics out of such conduct. It's wrong, it is sexual and oftentimes does just as much psychological damage as any other way. To me, it's rape. No question about it.

    With that said, I am so sorry to hear that this has happened to you. 😞 I am glad to see though, that you are in therapy for what happened. I can only hope you find some strength, resolve and peace in time over what has happened, and that the pain you may feel now lessens over time.

  • Florida law defines the crime of sexual battery:

    “Sexual battery” means oral, anal, or vaginal penetration by, or union with, the sexual organ of another or the anal or vaginal penetration of another by any other object; however, sexual battery does not include an act done for a bona fide medical purpose.

    The penalties depend upon the age of the victim and perpetrator. the perpetrator's prior criminal history, and certain facts about the victim (enhanced penalties if victim is physically or mentally disabled, in victim is drugged, etc.)

  • I would consider it rape. He forcefully penetrated you without your permission.. just because it wasn't with his dick, doesn't mean it wasn't rape. This is my opinion. I'm not sure what the law would define it as.. sexual battery, assualt, etc. I define it as rape as soon as penetration is involved and assualt/battery if no penetration is involved. I think this why people can be with "multiple counts" of something. Listen.. I have no idea what I'm talking about, so don't take my answer to heart.

  • I don't think it matters whether or not forced fingering is considered to be rape because I believe this question, ironically, wouldn't help with your situation, as people would then be killing themselves over terminology rather than the actual events that took place.

    The more obvious question to ask is "Is it legal to forcibly finger a woman?" And the answer would be, "Of course, not! Whether it's considered rape or not, it's still sexual harassment, which is illegal"

    Effects depend more on you and how you felt during/after the encounter than they do on what actually took place for the most part so I wouldn't say it was more or less severe than anything else. Your calm discussion of it leads me to believe you handled it fairly well but you obviously know the answer to that question better than I do.
