Is it assault if a guy hooks up with a girl whilst she’s black out drunk and she wakes up and he’s inside her?

Superb Opinion

  • YES

Does she have the capacity to know abs understand what she is consenting to? If the answer is anything less than a confident yes, it's a sexual assault.

But what If he was equally drunk?

Then you are both idiots and you have no case.

  • Yes, if a person engages in sexual activity with someone who is unable to give consent due to being unconscious or incapacitated by alcohol or drugs, it is considered sexual assault. Consent is a crucial component of any sexual activity, and if it is not given freely and enthusiastically, it is not consensual. It is important to remember that sexual assault is a serious crime and can have lasting physical, emotional, and psychological effects on the victim. If you or someone you know has experienced sexual assault, it is important to seek help and support from a trusted friend, family member, or professional.

Most Helpful Girls

  • Not if they engaged before the black out. It’s wrong if she’s sleeping on the couch and he just pounces on her without her agreeing. My friend went to a party and feel asleep in a room after getting drunk and a group of guys assaulted her. When she woke up she was being held down. While they took turns. It’s sad

  • Depends if they're both black out drunk. Morally.

Legally the guy is always held as the responsible party. Even when both parties are voluntarily drunk.

Men are always considered in control :T Even when they're not. So much for feminism.

    • Oh well, feminism is about man blaming and man hating and women taking no responsibility.

  • Yes.

If a guy blacked out drunk and woke up to a dildo in his ass I'm pretty sure that's not consensual and pretty ducking traumatizing.

  • Absolutely. Actually, it's rape.

  • That’s not just assault, that’s rape. A person can’t consent if they are drunk.

  • No. She got herself in that situation. How do we know if he's not drunk? She should not overrhink it and just enjoy the pounding

    • That ever happen to you?

    • Fantastic answer

    • @BrookeS yeah tbh I miss those times. Now all the guys are too cautious

  • Very much so.

  • This in law would be classified as Rape.

  • Truthfully. If he waited until marriage he wouldn’t have to worry about it.

Stop being a degenerate and you won’t have to worry. Same for her. She ain’t innocent either.

    Make better choices

    • If she is passed out and he has sex with her that’s rape

  • Yes, unless he's her boyfriend/hubby and she's said that she'd be okay with him doing that.

  • That's rape.

  • Its a complex world now, but I would say yes, generally.

  • It's a tuff one. Because she could have said yes and was in on it, but now she don't remember it. The best is to just don't have sex while drunk

  • Yeah that's rape

  • Yea it is

  • It's kinky AF, but he better keep going, it's the last time will see pussy for years and years.

    • Only if she goes to the police. Which I wouldn't

    • @Andreasucker I am going to the police.

    • To the asker, you should not be talking about it on here then.

  • It's rape obviously

  • Nope, not in the UK it isn't. At least juries won't convict and rightfully so. This case the other week, was where this woman was raped two guys, both strangers to each other and the woman. She was not just drunk but of her face on all sorts of drugs including ketamine. She did not try and stop the rape probably because of the substances she had abused. Both 'rapists' acquitted.

She should take some responsibility, the onus is on her withdrawing consent and saying no. You are not usually going to get a guilty verdict unless the women expresses she does not want it.

    • Oh! Good to know that in the UK it's not fucking crazy yet.

    • @Andreasucker Give it time, but i wouldn't say we are not crazy. We have just made wolf whistling a crime as well as following too close to someone at night.

  • That's called rape.

  • Yes it is. It will probably be his word against hers but people will be more likely to take her side.

  • Yes. Plain yes.

  • noooo he didn't ask her to drink.. so he find his chance to go on..

    • Partially true! If she consumed with him she probably had the I intention

    • @tinydiva1991 I didn’t. I was out with a friend and I started talking to him

    • thats ur fault.. in that moment when u fucked him u were accept that at all so its not rape
